LCLAA on Fifth Circuit DACA Decision

Washington, DC - The Labor Council for Latin American Advancement (LCLAA) is deeply disappointed in the Fifth Circuit Court of Appeals’ decision yesterday regarding Deferred Action for Childhood Arrival (DACA) program. The court chose not to rule on whether or not the Biden Administration’s new regulation of the program is legal and instead chose to leave this decision to Judge Hanen in the U.S. District Court in the Southern District of Texas. 

The court maintained a stay of the program which allows the program to stay in place for existing DACA recipients and allows these recipients to renew and retain the validity of their work authorization. 

Yanira Merino, National President of the Labor Council of Latin American Advancement, said: “While yesterday’s ruling provides a temporary relief to DACA recipients, it once again fails to provide DACA recipients with a firm decision. I am deeply disappointed by the courts’ lack of action that only continues to keep DACA recipients in a state of uncertainty. It is time now for Congress to take legislative action to protect Dreamers and to provide a stable path to citizenship for immigrants.”
